Terms and Conditions
1. Estimates Only: Floor Plans, Measurements, Square Footage, and Lot Lines
All floor plans, dimensions, square footage figures, lot lines, and measurements provided by Company are approximate estimates only and are provided for marketing and reference purposes only. They are not a survey, appraisal, inspection, or guarantee of exact size, boundary lines, or accuracy. Client is solely responsible for independently verifying any information they wish to rely on. To the fullest extent permitted by law, Company shall not be liable for any discrepancy, inaccuracy, omission, or reliance relating to floor plans, measurements, square footage, or lot line depictions.
2. Revision Policy
Delivered media includes up to three (3) rounds of revisions. Any revision requests beyond three (3) rounds may be subject to additional fees at Company’s then-current rates.
3. Revision Deadline / Approval of Media
All revision requests must be submitted within seven (7) calendar days of the media delivery date. If no revision request is submitted within seven (7) calendar days, the media shall be deemed accepted as delivered. Any revision or change request submitted after seven (7) calendar days may be treated as a new service and may be subject to additional fees.
4. Preferences and Requested Features
Any personal preferences, stylistic preferences, feature requests, shot priorities, room priorities, music preferences, pacing preferences, or similar requests must be communicated to Company before or during the shoot. Requests first made after the shoot may be treated as new requests and may result in additional charges, including reshoot fees.
5. Free Reshoots for Company Error
If Company determines that a material error was made by Company in capturing the ordered media, Company may provide a reshoot at no additional charge, provided the issue is reported within seven (7) calendar days of delivery.
6. Preference-Based Reshoots
Reshoots requested due to personal preference, change of mind, unstated preferences, styling preferences, updated instructions, or other non-error-based reasons may be subject to additional fees. Company reserves sole discretion to determine whether a reshoot request is error-based or preference-based.
7. Payment / No Delivery Until Paid
Payment is due according to the invoice terms provided by Company. Company reserves the right to withhold delivery of any final media until all invoices and outstanding balances related to the order have been paid in full.
8. Turnaround Times
Any turnaround times provided by Company are estimates only and are not guaranteed. Standard turnaround begins only after the shoot has been completed and all required information, instructions, approvals, scripts, and selections have been received by Company. Delays caused by missing information, revision requests, weather, technical issues, weekends, holidays, or circumstances outside Company’s reasonable control may extend delivery times. Company does not deliver media on Sundays unless otherwise agreed in writing.
9. Property Readiness / Client Responsibility
Client is responsible for ensuring the property is ready for the shoot at the scheduled appointment time. This includes ensuring access to the property, securing pets, having utilities turned on, having all requested rooms and areas available, and completing any desired cleaning, staging, decluttering, or preparation before Company arrives. Company is not responsible for cleaning, staging, moving heavy items, or preparing the property beyond minor presentation adjustments made at Company’s discretion during the scheduled appointment time.
10. Weather / Rescheduling
Company reserves the right to postpone, reschedule, or modify any shoot due to weather, unsafe conditions, restricted drone conditions, lighting conditions, or other circumstances outside Company’s reasonable control that may affect safety or quality. Company shall not be liable for delays, rescheduling, or incomplete services resulting from such conditions.
11. Drone Services
Drone services are subject to weather, safety conditions, airspace restrictions, signal or GPS limitations, legal restrictions, location restrictions, equipment limitations, and compliance with applicable FAA requirements. Company reserves the right to cancel, modify, postpone, or reschedule drone services at its sole discretion if drone operations are unsafe, restricted, impractical, or not legally permitted at the time of the appointment. Company does not guarantee drone coverage under any conditions that would violate safety standards or applicable rules. Commercial drone operations in the United States are generally governed by FAA Part 107 requirements and related operational restrictions.
12. Ownership of Media
All photographs, videos, floor plans, drone content, 3D tours, edited files, and all other media created by Company remain the sole property of Company unless otherwise agreed in writing. Original creative works such as photographs generally receive copyright protection once created and fixed in a tangible form, and ownership generally remains with the creator unless rights are transferred by written agreement or another exception applies.
13. License to Purchaser
Upon full payment, the purchaser of the media is granted a limited, non-exclusive, non-transferable license to use the delivered media for marketing, advertising, and promotional purposes. No ownership rights are transferred to Client. Media may not be sold, reassigned, sublicensed, or transferred to any third party without Company’s prior written consent unless otherwise agreed in writing.
14. Company Use of Media
Company retains the unrestricted right to use any media created for its own portfolio, website, social media, advertising, promotional materials, internal training, and other business purposes, unless otherwise agreed in writing before the shoot.
15. No RAW Files / Source Files
RAW files, unedited files, source files, project files, and original footage are not included in any standard service unless specifically stated in writing by Company. Company has no obligation to release RAW files, source files, or other unpublished materials.
16. Virtual Staging / Virtual Twilight / Digitally Altered Media
Virtual staging, virtual twilight, object removal, lot lines, and any other digitally altered or enhanced media are for marketing and illustrative purposes only unless otherwise stated. Such media may not reflect the property’s current or exact physical condition. Client is solely responsible for complying with any MLS, brokerage, advertising, disclosure, or platform requirements relating to the use of virtually staged, virtually altered, or otherwise enhanced images.
17. File Storage / Archive Policy
Company will maintain delivered media and related project files for up to ninety (90) days after delivery. After ninety (90) days, Company is not required to retain, archive, restore, replace, or reproduce any files, and Company makes no guarantee that any media will remain available after that period.
18. General Limitation of Liability
To the fullest extent permitted by law, Company’s total liability for any claim arising out of or relating to the services or media provided shall be limited to the amount actually paid by Client for the specific service giving rise to the claim. In no event shall Company be liable for any indirect, incidental, special, consequential, exemplary, or lost-profit damages, including but not limited to loss of listing opportunities, marketing delay, business interruption, or third-party claims.
